These Terms of Service (“ToS”) govern access to and use of the GreenQRCode service, available from www.greenqrcode.com and its associated application (“the Service”).
By creating an account or using the Service, you acknowledge that you have read, understood, and accepted these ToS without reservation. If you do not accept these Terms, you must not use the Service.
GreenQRCode reserves the right to modify the ToS at any time. The version applicable is the one published on the website at the date of your use. It is your responsibility to review this page regularly. Continued use of the Service after updates constitutes acceptance of the new ToS.
GreenQRCode is a platform for creating, customizing, and hosting QRShowcases — digital mini-sites accessible through dynamic QR codes. Without limitation, the Service includes:
Details of features, limits, and options for each plan (trial periods, monthly or yearly subscriptions, promotional offers, etc.) are listed on the Service presentation and pricing pages. GreenQRCode may update this scope (adding, modifying, or removing features) under reasonable conditions, without affecting acquired rights and in compliance with applicable laws.
GreenQRCode may offer a trial period (free or discounted) allowing users to test the Service and create one or several QRShowcases under near-real usage conditions.
The conditions of the trial period (duration, scan limits, number of QRShowcases, included features, etc.) are specified on the website at registration or activation. GreenQRCode may adjust or discontinue the trial offer at any time for future users, without retroactive effect on trials already in progress, except in cases of fraud or clear abuse.
GreenQRCode reserves the right to limit, suspend, or delete an account or QRShowcase created during a trial period (e.g., prolonged inactivity, abuse, excessive use, or content violating these ToS), without compensation or obligation to provide detailed justification.
GreenQRCode offers paid plans as subscriptions (e.g., monthly, yearly, or other frequencies), granting access to a certain number of dynamic QRShowcases and associated features. Unless otherwise stated, these plans:
Subscription renewals occur automatically unless cancelled by the user under the conditions set out in Article 11 or any specific terms on the website. Any subscription period already started is due in full, unless otherwise stated by mandatory law.
GreenQRCode may update plan names, pricing, or content at any time. Changes do not apply retroactively to subscription periods already paid for, except if required by law, or if the changes improve the Service without reducing essential user rights.
The description visible on the website at the time of subscription or renewal prevails, subject to correction of obvious errors or mandatory legal updates.
Each plan may include scan limits (per QRShowcase and/or per account, per period such as calendar month), as well as other technical quotas (storage, number of QRShowcases, number of users, etc.), as listed on the Service presentation or pricing page at subscription time.
Unless explicitly stated as unlimited, the user must comply with these quotas and make reasonable use of the Service, consistent with typical digital showcase usage (as opposed to automated load testing or platform misuse).
In the event of excessive quota use, abnormal traffic, or scan patterns consistent with attacks (bots, automated scans, etc.), GreenQRCode may:
Use of the Service is restricted to individuals aged 18 or older, or legal entities represented by an authorized person. By creating an account, you confirm that you have the necessary legal capacity.
To use the Service, you must create an account and provide accurate, complete, and up-to-date information. You agree to update this information when necessary.
Your login credentials are personal and confidential. You are solely responsible for all actions performed through your account, even if performed by a third party. You must notify us without delay in case of suspected unauthorized access.
Unless explicitly stated otherwise, each GreenQRCode account is personal and linked to a specific individual or legal entity. Unauthorized sharing (resale, mutualization, etc.) is prohibited and may result in suspension or termination.
Paid plans require recurring payments at the price indicated at purchase or renewal. Payments are processed through secure payment providers (Stripe, PayPal, etc.).
You agree not to use unauthorized payment methods. In case of failed payment, GreenQRCode may suspend access or limit features until the issue is resolved.
Unless stated otherwise, prices are inclusive of VAT for clients located in the European Union, in accordance with applicable regulations. An invoice may be provided in your dashboard or by email.
Unless required by mandatory law (e.g., consumer withdrawal rights), amounts paid for a subscription period already started are non-refundable. In case of fraud, abuse, or chargeback, GreenQRCode may suspend or terminate the concerned account.
You agree to use the Service in compliance with applicable laws, third-party rights, and these ToS. You are fully responsible for all content created, uploaded, or shared through your QRShowcases.
It is strictly prohibited to use GreenQRCode for hosting, transmitting, or promoting:
If you use QRShowcases in regulated sectors (health, finance, gambling, etc.), you are solely responsible for compliance with applicable regulations.
GreenQRCode may suspend or delete any QRShowcase or account violating these ToS, applicable laws, third-party rights, or presenting clear danger (phishing, mass spam, etc.), without compensation, subject to mandatory legal requirements.
The Service, its structure, source code, design, logo, trademarks, interfaces, and all components (excluding user content) are the exclusive property of GreenQRCode or its partners. They are protected by French and international intellectual property laws.
You are granted a non-exclusive, non-transferable, revocable right to use the Service under these ToS. Any unauthorized reproduction, distribution, modification, or exploitation is prohibited.
Processing of personal data (accounts, logs, analytics, email) is detailed in the Privacy Policy, which forms an integral part of these ToS.
QRShowcases and their content (text, images, links, etc.) are hosted on GreenQRCode infrastructure or that of its providers. We implement reasonable measures to ensure security and availability, without absolute guarantee.
GreenQRCode may collect technical and statistical data related to scans (timestamp, device type, approximate location, etc.) for Service operation, product improvement, and security. Retention periods and level of detail depend on the chosen plan.
GreenQRCode strives to maintain reasonable availability but cannot guarantee uninterrupted, error-free service. Temporary interruptions may occur (maintenance, updates, technical incidents, force majeure).
GreenQRCode may:
GreenQRCode cannot be held liable for consequences of temporary unavailability (e.g., reduced visibility, momentary scan failure), unless otherwise required by law.
You use the Service at your own risk. GreenQRCode does not guarantee complete absence of bugs, vulnerabilities, or incompatibilities with all devices, browsers, or networks.
To the extent permitted by law, GreenQRCode shall not be liable for indirect or consequential damages, including loss of revenue, clients, data, image, or profits.
You may request account closure at any time using the provided interface or by contacting contact@greenqrcode.com. Account deletion disables your QRShowcases, except as required by law.
Account deletion does not entitle you to refunds for subscription periods already paid, except where legally required.
GreenQRCode may suspend or terminate your account without notice in cases such as:
Unless otherwise required by law, paid amounts remain due and are non-refundable when termination is due to fault or abuse.
GreenQRCode may modify the Service (interface, features, subscription offers) or discontinue it for legal, technical, or economic reasons. When possible, users will receive reasonable notice.
If the Service is permanently discontinued, GreenQRCode may provide reasonable means to export certain data, without obligation of continued service beyond legal requirements.
These ToS are governed by French law. In case of disputes regarding their interpretation, execution, or validity, and failing amicable resolution, the competent courts shall be those of Paris, France, unless otherwise required by mandatory law.
These ToS, together with the Privacy Policy and any complementary policies on the website, constitute the entire agreement between you and GreenQRCode.
If any provision of these ToS is found invalid or unenforceable, the remaining provisions shall remain in full force.
Failure by GreenQRCode to enforce a right shall not constitute a waiver of that right.
GreenQRCode may assign or transfer its rights and obligations to a third party (e.g., merger, acquisition), without reducing user rights or increasing obligations.
